Terms and Conditions

The following are terms and conditions (hereafter “Agreement”) of Flyy Family, LLC, (hereafter “Company,” “We,” or “Our”). You, the traveler (hereafter referred to as “You,” “Your,” or “Traveler”), agree to be bound to this Agreement upon and by signing up for any trip or retreat hosted by Company.

 

  1. Deposit. Upon signing up for the trip, You will be required to pay a deposit to secure your spot on the trip. Spaces are limited and offered on a first-come, first served basis. All deposit payments are nonrefundable and cannot be transferred to another trip. 

  2. Pricing.

    1. Pricing information for each trip can be found on our company website: https://www.flyyfamily.com.

    2. Final payment will always be due 90 days prior to the trip.

    3. Company will not reimburse any trip attendee if any part of the trip is missed for any reasons. This includes but are not limited to late arrival due to flight delays, early departure, delayed airport transfers, etc.

    4. Company will not reimburse any trip attendee if the itinerary changes for any reason for any activities that may be changed.

  3. Payment Terms.

    1. Payment will be made online via valid credit or debit card. If Company requires that you sign up for recurring/auto-payment for a particular trip, it will advise of this at the time of purchase.

    2. You will be invoiced on the 1st of each month for the number of months payments are collected per Section 2 of this Agreement and the provided trip information.

    3. There will be a five (5) day grace period during which if the payment is not made or is declined you will have to remit a successful payment. If you are on a recurring, auto-payment plan, the system will try to charge your card once a day for each day during the grace period. After the 5th day of the month a payment is due, the payment will be deemed late and missed, and the Your spot on trip will be cancelled.

    4. If any payment is missed, your trip will be cancelled and all payments made until that point will be nonrefundable and non-transferrable for credit.

  4. Traveler Requirements.

    1. It is Your responsibility to provide Company with accurate contact information, including travel and emergency contact information. Trip registration should be made in the name as it appears on Your and all attendees’ passport. Attendees are required to ensure that their passport has the minimum validity period required in order to travel. This is usually six (6) months of validity after the scheduled date of return of the trip, but You are responsible for confirming such information.

    2. You are also responsible for obtaining correct information on and applying for, and timely receiving, and procuring a valid visa for any country that may need one based upon attendee’s passport or citizenship country. Company bears no responsibility if attendee is unable to attend the trip due to lack of passport validity or lack of valid visa for travel or due to changes in visa requirements. Be sure to check with the relevant government entity for the trip. 

    3. Immunizations: Company will, as a courtesy, make its best efforts to alert members if an immunization is mandatory for entry into a country.  Outside of mandatory immunizations, Company will not provide any immunization recommendations or suggestions.  Company is not responsible for any changes in requirements or misinformation so it is important to do your own research. Participants should contact their doctor or the Center for Disease Control (CDC) or relevant state department or consulate websites for any immunization questions. ​Immunization costs are not included in the cost of the trip and are solely the responsibility of Traveler.

    4. Company will require you to provide the following:

      1. Your full name, as it appears on Your passport;

      2. The full names of all other attendees in your booking, as it appears on their passports;

      3. Proof of travel insurance for all members of your reservation;

      4. Visa information, if required, for all members of your reservation;

      5. Flight information including airline, flight number, arrival time and departure times;

      6. Any other information as requested by Company.

    5. You are required to submit flight and travel insurance information to Company at least 6 weeks before trip departure date. Company will provide each trip attendee with a link to submit requested information. If information is not timely submitted, then Company is not liable for or required to book airport transfers, if that is included in the trip package. If information is submitted late, Company may cancel your participation in the trip, at its sole discretion.

    6. You are required to make sure you know, understand, and are compliant with any COVID or other testing or vaccine requirements as required by any country that is included on the trip. Traveler is responsible for any and all testing costs or any costs associated with failing to meet testing requirements.

  5. Exclusions. The following is excluded from the price of the trip.

    1. Vaccination or immunization costs;

    2. Transportation to and from the trip destination;

    3. Additional fees relating to baggage fees, baggage overages, upgrades, parking, or any additional services that attendee may request;

    4. Any meals that are not listed in the itinerary;

    5. Free day activities;

    6. Transportation to and from free day activities or any activities that are not official activities on the itinerary;

    7. Shopping expenditures

    8. Visa or country’s entry/exit fees;

    9. Travel insurance costs, fees, or deductibles.

  6. Rooming Limitations. Only four (4) individuals/family members, including children, shall be allowed in any room. If you wish to book with more than 3 other people, you will be responsible for obtaining a second room. This includes children of all ages, which are to be included in the count.

  7. Cancellation.

    1. If a trip is cancelled by Traveler, Traveler is not entitled to any refund. Company will offer Traveler 100% of the payment (less the deposit) as a credit for a future trip if cancellation is made more than 100 days prior to the scheduled start of the trip. If cancellation is made less than 90 days to the trip, then Traveler will receive no credits towards a future trip for payments made, nor is Traveler entitled to any refund.

    2. Company has the right to cancel or postpone any trip for any reason and at its sole discretion upon notice to Travelers. If Company cancels or postpones a trip, Company is not liable for any incidental or other expenditures that Traveler may have already expended, including airfare or other nonrefundable expenditures.

    3. If Company cancels a trip for any reason other than force majeure as detailed in Section 8 of this Agreement, Company will provide Traveler with a credit for future trips or the rescheduled trip, but no refunds will be provided.

    4. If Traveler obtains a credit for a future trip, that credit must be used in the same or following calendar year that the credit is issued. The credit can only be applied to one (1) future trip. Traveler will still be required to book any subsequent trip as usual by paying the deposit to secure a spot on the new trip. Traveler can then notify Company of your intent to use the credit to be applied to that trip, and any remaining cost overage for the new trip will be split into equal monthly payments or you can pay the difference in one payment immediately upon notification of the excess amount.

    5. If Company cancels the trip and issues a credit, it must be redeemed for a trip that is within 85% of the cost of the original trip. If the new trip is no more than 15% less expensive that the original trip, the excess will be refunded to Traveler.

  8. Force Majeure/Impossibility of Performance. We shall not be deemed to be in violation of this Agreement if we are prevented from performing any of its obligations hereunder for any reason beyond its control and without fault, including without limitation, acts of God or of the public enemy, man-made disaster, flood or storm, pandemic, strikes or statutory regulation or rule of any federal, state, or local government, or any agency thereof, however, the Company shall exercise its best efforts to remedy any such cause of delay or cause preventing performance. An additional addendum to which you are bound is included as Addendum A.

  9. Communication.

    1. Prior to the trip: Company will communicate via email for all updates regarding the trip. Traveler is responsible for ensuring that Company has an accurate and correct email address for Traveler and that Traveler is regularly checking email and spam folders for emails from Company.

    2. During the trip: Communication while on the trip will be primarily via Whatsapp, with potential email updates. All adult Travelers on the trip will need to provide cellular phone information and will need to be on the lookout to join the Whatsapp group link. Traveler will be responsible for ensuring that Traveler has service during the trip and access to Whatsapp updates while traveling.

    3. Company will strive to send travelers a finalized schedule 60 days prior to the start of the trip. If changes occur, Company will advise travelers of any changes.

  10. Adherence to Local Laws. Traveler agrees to abide by all applicable domestic and international laws and regulations in the countries of travel and residency, regardless of length of time in said countries. If questioning, apprehension/arrest, detainment, punishment, or incarceration by lawful authorities occurs, Company shall not be responsible or liable, either legally, financially or otherwise, for Traveler's actions or release nor if Company continues the trip and/or travel itinerary without Traveler. Should Traveler run into a legal issue, Company will attempt to reach the emergency contact as listed with Traveler’s information.

  11. Hotel Deposits. Company covers the full price of each room; however, You may be asked for a credit card upon check-in for their room incidentals. If this is a requirement, You must provide your own card to the hotel or accommodations on request.  Company will alert members when providing the final trip itinerary deposit amount required by the hotel if that information is made available in advance.  The trip attendee is responsible for all incidentals payable to the hotel or resort.

  12. Wi-Fi. During periods of the trip I may or may not be able to access Wifi. And that sometimes the Wifi signal can be spotty. We cannot guarantee working Wifi or Internet at any time during the trip.

  13. Traveler Considerations. The following are considerations that You should bear in mind when attending a Company trip.

    1. Flexibility: The ideal traveler for Company trips is someone who embodies patience, flexibility, a willingness to try new things, appreciations and respect for diversity (e.g., people, customs, languages, religions), a desire to learn, grow, evolve, enjoys engagement with other attendees, and understands that travel sometimes comes with unexpected situations and is able to be flexible if a situation arises. We will do our best to ensure that our trips run according to schedule.  However, trip attendees should be aware that at times we run ahead or behind schedule.  Attending our trips will require that participants are patient at times. 

    2. Engagement: Group engagement is welcomed and encouraged amongst all trip attendees. If for some reason your behavior is causing issues or negativity on the trip, Company reserves the right to ask you not to attend future activities on the present trip and to ban you from attending future trips.

    3. Activities: Company will make travelers aware of the intensity level of all trips before booking. By booking a trip, you agree to the intensity level of the trip and have cleared with any relevant medical professional that you are cleared to travel and participate in the trip.  Our trips are often packed with activities, on a daily basis. Trip attendees are welcome to opt out of any day or activity.   There are no credits given if trip attendee decides to sit out or not attend an activity.  

    4. Transportation: Company will provide transportation as detailed in the original trip listing, which includes transportation to all official activities. Company will also indicate if airport transfers are available for each trip and the conditions applicable to such transfers. Transportation will not be provided for optional activities or any “free day” activities. Company is also not responsible for any travel to and from the destination.

    5. Timeliness: Our group activities operate on time.  There will be no refunds given nor any special arrangements made for anyone who decides to show up late.  Trip attendees will be advised each evening of the time we will be departing the following day.  Out of respect for everyone’s time, we will leave on time, with or without you.  We will not make any special arrangements if we depart without you.​

    6. Shopping: Company trips have itineraries that are busy but there will be breaks in our trips that allow for some time to shop, although it may be limited in scope. The trips are not geared towards shopping, and You are responsible for knowing shopping and import limits based upon your country of residence.

    7. Local Customs​: There will be times on our trips that participants will be interacting with locals on various levels, depending on the trip. We ask that attendees be mindful respectful of local customs. Our cultural trips are focused on getting to know the people and are designed to be less touristy, which excludes major tourist attractions.

    8. Dietary Restrictions or Allergies: Trip attendees should be aware that unlike the US, many of the places we visit may not have the variety of meal options to cater to restricted diets.  Strict dietary restrictions may result in minimal food options for those attendees who may be vegan.  We will do our best to take dietary restrictions into consideration but cannot guarantee suitable food options depending on the location and restriction. You are solely responsible for ensuring your safety if you have food allergies or dietary restrictions.

  14. Photography and Video. Traveler grants The Company the right to take photographs, record videos, and/or use social media posts of Traveler in conjunction with travel and/or activities hosted by The Company, before, during, and after such travel and activities. Traveler authorizes The Company, its employees, contractors, assignees, transferees, agents, and any other third parties working on The Company’s behalf, to copyright, use, and publish the photographs, videos, and social media posts in print and/or electronically. The Company may use videos, photographs, or social media posts of Traveler with or without Traveler's name and for any lawful purposes, including for example, such purposes as publicity, illustration, advertising, promotion, fundraising, and social media / internet content. The Company is released from any reasonable expectation of privacy or confidentiality associated with such content. Traveler acknowledges she does not expect and will not receive consideration, financial compensation, or royalties of any kind associated with the taking, publication, or other use of such photographs, videos, and social media posts. Traveler further releases Company, its employees, contractors, assignees, transferees, and any third parties acting on Company’s behalf from any liability or claims by Traveler or any representative of Traveler, including those relating to right of publicity or usage of Traveler’s name, likeness, image, voice, or any other identifying trait.

  15. Disclaimers.

    1. Not all places have familiar standards of the Western world (customer service, service times, food variety, air conditioning, ice, straws, cold water, cultural, religious norms, transportation, facial towels, etc.). Company encourages all guest to research on our destination before the trip is booked so that each guest is well aware of the conditions of where we are traveling.

    2. Traveler agrees that their safety is primarily their own responsibility. Traveler agrees to make sure that they know how to safely participate in activities, and agrees to observe any rules and practices that may be employed to minimize the risk of injury. Traveler agrees to stop and seek assistance if they do not believe they can safely continue, to limit their participation to reflect their personal fitness level, and to refrain from any and all actions that would pose a hazard to Traveler or others. Traveler understands that as with any physical activities, they should check with their doctor prior to embarking upon such activities to verify if they are medically able to participate in any activities. By signing this form, Traveler acknowledges that they have checked with their doctor and been cleared for any activities that they shall participate in, and that Company bears no liability for any activity or outcome that may adversely affect the health or well-being of Traveler.

    3. Traveler agrees to participate in the trip and related activities that are held and sponsored by Company, but it is Traveler’s responsibility to determine if Traveler is unable to participate safely and opt out of any activity, as needed. Traveler agrees to release, waive, discharge, dismiss, and covenant not to sue, and agree to hold The Company, its members, officers, directors, servants, agents, volunteers, contractors, tour guides, employees, and agents harmless from and against any and all liabilities, lawsuits, demands, suits, costs, claims, causes of action, or injuries, including death or dismemberment, that Traveler may sustain during or in conjunction with the trip or related activities. This total waiver of liability is intended to be a full and complete waiver and release of Company from any liability for any damages or injuries that may occur as a result of the trip or related activities, and that Traveler is giving up any rights to legal recourse that they may have or obtain against Company or its related parties as Traveler is participating in any an all activities, and the trip as a whole, at Traveler’s own an informed risk. This provision shall be binding upon the heirs, successors, assigns and agents of Traveler as well.

    4. Traveler understands it is their responsibility to arrive in time for travel departure or event or activity start. Company assumes no responsibility, liability, or expense for Traveler's inability to travel or participate in any activity or event hosted by Company due to insufficient, inaccurate, or expired travel, medical, and identifying documentation by Traveler, or failure to arrive on time for travel departures or participation in events or activities for any reason, including those reasons that are out of the control of Traveler.

  16. Indemnity. Traveler agrees to release, discharge, dismiss, indemnify, covenant not to sue, and hold harmless Company, its officers, members, directors, employees, contractors, vendors, travel guides, assignees, transferees, agents, and any other third parties acting on Company's behalf against any and all lawsuits, demands, expenses, losses, damages, accidents, injuries, claims, or deaths resulting in whole or in part, either directly or indirectly, from any aspect of travel and/or activities facilitated by Company. Traveler further agrees that in no event and under no circumstances shall Company, nor its officers, directors, members, employees, vendors, guides, contractors, assignees, transferees, agents, and other third parties acting on Company’s behalf bear any total or aggregate liability (either jointly or severally) under Agreement that exceeds the amount of total fees paid by Traveler to Company for the particular trip in question.

  17. Use of Third Party Vendors. Traveler understands that Company offers travel services, events, and activities to customers, which are provided by separate and independent vendors. The Company does not operate, control, or otherwise provide the services of these vendors. Hence, customer understands and agrees that Company is not responsible for any operating failure, delay, loss, damage, or injury to Traveler or any resulting claims or damages arising as a result. Traveler, by signing up for this trip, agrees not to bring any claim, cause of action, demand, lawsuit, or other action against Company based upon the actions, lack of action, negligence, willful action, or mistake or third party vendors. Further, Company does not and cannot guarantee a certain outcome or a particular result in conjunction with any travel, activities, or events arranged by Company. While Company will use its best professional efforts to achieve a successful outcome, Company makes no promise, warranty, or guarantee, either express or implied, as to a specific outcome or result, or the expectation, perspective, or experience of Traveler.

  18. Additional Terms.

    1. Agreement constitutes the entire agreement between the parties. There are no other promises, obligations, or terms and conditions, either oral or written, either express or implicated. This Agreement shall be governed by the laws of the state of California in the United States. The contract takes place in Alameda County, California. Any attorney fees for any breach shall be borne by the losing party if litigation ensues.

    2. By signature below, both parties acknowledge they have read and understand Agreement, and voluntarily and fully agree to all terms and conditions set forth within. This Agreement shall bind the heirs, assigns, successors, etc., of Traveler.

    3. Making reservations for this package signify your acceptance of Our Terms and Conditions. All members who submit this signed registration will be held to all terms as listed on the form.

Policy on COVID-19 and Other Global Events

The following policies and procedures are applicable with response to global diseases/pandemics, natural disasters, border closings/quarantines, acts of God, and acts of war/terrorism, emergent situations, civil unrest or turmoil in the country (hereinafter “Global Events”), or any other reason and travel policies as applicable to all Flyy Family trips.

 

By way of background, in recent years, there have been an onslaught of global illnesses that have had some level of contagion that have affected travel. In recent months especially, the prevalence of COVID-19 (commonly referred to as the “coronavirus”) has had in impact on the travel industry including flight cancellations, trip cancellations, and more. This policy shall be applicable to any trip that is cancelled for any reason, either relating to a Global Event, or for any other reason.

 

By booking this trip, you are agreeing to the following:

 

  1. These provisions apply to COVID-19 or any other communicable disease that may arise or currently exists now or in the future, or for any reason/Global Event listed above and below, or for any reason, even if unstated, in the sole discretion of Flyy Family.

  2. Flyy Family has and reserves the right to cancel or terminate any trip at any time, in its sole discretion and at its sole determination. Flyy Family shall be able to cancel any trip for any reason or sole discretion, including, but not limited to: global pandemics/diseases, natural disasters, border closings/quarantines, acts of God, acts of war/terrorism, civil unrest or turmoil in the country or reason.

  3. In the event that any trip is cancelled, for any reason, Flyy Family will not issue refunds of any payments made for any reason. Travelers will only be entitled to credit for future trips. If an Traveler elects not to attend a trip for any reason other than Flyy Family cancelling the trip, the payment rules and provisions as stated in other sections of Flyy Family’s terms will prevail.

  4. If any trip is cancelled, Flyy Family will solely provide email notification to attendees. Travelers are responsible for ensuring that they are checking their email and receiving emails from Flyy Family. Flyy Family is not obligated to give any other form of notice of trip cancellation. We will keep you updated timely and if there is no notification as to cancellation you can proceed as planned.

  5. Traveler understands and acknowledges that international travel is an ever-changing situation and Flyy Family will do its best to keep attendees reasonably informed of any changes that may affect the trip, for any of the reasons detailed above.

  6. Travelers are required and responsible for obtaining adequate travel insurance to cover the trip. Flyy Family recommends that attendees acquire “cancel for any reason” insurance to better ensure coverage in the event of a global “pandemic” or other level spread of illness or any other Global Event, though Flyy Family makes no guarantees as to such coverage. Flyy Family will not be responsible for:

    1. The cost of any travel insurance that Traveler procures;

    2. The cost of any expenditures that Traveler incurs relating to any cancelled trip; or

    3. Any costs that are denied coverage by travel insurance, either through claims or otherwise.

    4. For the avoidance of doubt, by way of example, if Traveler’s travel insurance will not cover a flight for a cancelled trip, Flyy Family bears no responsibility for covering or reimbursing Traveler for such expenditure.

    5. Please also note that Flyy Family cannot delay payments or hold spots while Travelers wait to learn about travel insurance claims.

  7. Flyy Family will closely monitor and will likely cancel any affected trip if the travel advisory for the country in which any portion of the trip occurs reaches a “Level 3” travel advisory. Flyy Family has the right to cancel any trip even if it doesn’t involve a travel advisory of Level 3, as well. Assessments regarding trips will be made on a case-by-case basis, at Flyy Family’s sole discretion.

  8. Flyy Family will do its best to let attendees know if a trip is cancelled at least three (3) months prior to the trip. However, this timeframe cannot be guaranteed and is not always feasible due to of the ever-changing nature of such travel advisories and Global Events, especially with respect to global pandemics/diseases. Flyy Family only advises that it will let attendees know as soon as is practicable.  

  9. If Flyy Family offers attendees the option to cancel or change a trip, there will be a very specific and stated timetable or window for such attendee-determined cancellations. Any Traveler cancellations outside of that stated period will result in the payments made being nonrefundable and non-transferrable. The option to change dates of a trip will be at Flyy Family’s sole discretion.

  10. If an Traveler opts to cancel outside of or beyond Flyy Family cancelling a trip, then standard rules regarding refunds and the nonrefundable nature of payments applies.

  11. For trips that are proceeding and are not cancelled, Flyy Family has the right to make changes to the itineraries and lodging, at its sole discretion.

  12. While Flyy Family realizes that airline pricing fluctuates and can change instantaneously, Flyy Family advises that it may be prudent, with the nature of COVID-19 and other diseases, and Global Events, that Travelers may not want to obtain plane tickets extremely early with respect to the trip, bearing in mind the fact that prices fluctuate. Ultimately, Traveler is responsible for her own airfare, and Flyy Family bears no responsibility for lost airfare or price increases or decreases in airfare, or lack of availability, even if a trip is cancelled for reasons outside the aforementioned reasons.

  13. Flyy Family is not responsible for the following for any reason, regardless of trip cancellation or continuation:

    1. Airfare purchased for the trip, whether the trip continues as scheduled, is modified or changed, is postponed, or is cancelled;

    2. Any costs associated with change fees for plane tickets;

    3. Any costs associated with quarantine orders, including but not limited to the following:

      1. If Traveler is quarantined overseas and unable to return to the country of origin or residence, for any period of time;

      2. If Traveler is quarantined upon arrival back at the country of origin or residence, for any period of time;

      3. If Traveler is required to “self quarantine” or “self isolate” upon return to her country of origin or residence; or

      4. Any costs associated with any such order whether they be direct or consequential (hotel costs, change fees, lodging, etc.) or incidental (loss in wages/employment, additional costs associated with quarantine, etc.).

  14. If Flyy Family elects to cancel a trip for any reason, the following will occur:

    1. Traveler will be notified promptly of the intent to cancel the trip.

    2. No payments that have been made will be refundable. Flyy Family will issue a credit to be used on a future trip.

    3. Flyy Family will provide Traveler with the amount of credit that will be afforded Traveler to be used on another trip.

    4. Any credit issued will only be for payments made to Flyy Family. It will not include payments made to any third party by Traveler.

    5. Any credit used can only be applied to one (1) future Flyy Family trip with a value of at least 85% of the initial trip cost. Trip credit must be used by the end of the next full calendar year.

    6. The usage of such credit will be applied to a trip with travel during the current or next calendar year. This means that the trip must be traveled or commenced by the end of the next calendar year, not that the deposit has been paid for a trip occurring in two years out.

    7. Trip credits will not be extended if the Traveler fails to use the credit or if the Traveler fails to book an available trip during the next calendar year. If trip credits are not used timely, they will be forfeited.

    8. No additional spots will be added to accommodate an Traveler who fails to book an open trip during the next calendar year.

    9. Traveler will still be required to book any subsequent trip as usual by paying the deposit to secure a spot on the trip. The Traveler can then notify Flyy Family of her intent to use the credit to be applied to that trip, and any remaining cost overage for the new trip will be split into equal monthly payments or Traveler can pay the difference in one payment immediately upon notification of the excess amount.

    10. Traveler will be allowed to make one transfer, and will not be permitted to transfer to a different trip and make additional transfers.

    11. Should the amount of the credit be in excess of the new trip price, Flyy Family will issue a refund for the balance amount to the credit card Traveler made the last trip payment with. All overage refunds will take up to 15 business days to process from the time that Traveler notifies Flyy Family that it intends to use credit on a particular trip and Flyy Family sends a confirmation of the booking and any overage amount.

  15. If Traveler files a dispute for reimbursement of payment for a trip that Flyy Family cancels or that Traveler no longer wishes to attend, all credits shall be forfeited, regardless of whether Traveler prevails in the dispute or not.
